Terms of Use (EULA) - TrackMyBooks

1. Agreement to Terms

By downloading, installing, or using TrackMyBooks (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

TrackMyBooks is a mobile application that allows you to:

  • Organize and manage your personal book library
  • Track book status (owned, wishlist, read)
  • Search for books by ISBN
  • Access AI-powered chat features about your books powered by OpenAI (Premium feature)
  • Access insights and recommendations (Premium feature)
  • Export and import your library data

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms.

4. User Accounts

4.1 Account Creation

  • You may create an account using Google Sign-In or Apple Sign-In
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account

4.2 Account Security

  • You must immediately notify us of any unauthorized use of your account
  • We are not liable for any loss or damage arising from unauthorized access to your account

5. Premium Subscription

5.1 Subscription Plans

  • TrackMyBooks offers Premium subscriptions on a monthly or yearly basis
  • Monthly: $2.99 USD per month
  • Yearly: $29.99 USD per year (save $6 per year compared to monthly)
  • Subscription fees are charged through your Apple ID or Google Play account
  • Prices may vary by location

5.2 Auto-Renewal

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Payment will be charged to your account within 24 hours prior to the end of the current period
  • You can manage subscriptions and turn off auto-renewal in your device's account settings

5.3 Cancellation

  • You may cancel your subscription at any time through your device's subscription settings
  • Cancellation takes effect at the end of the current billing period
  • You will continue to have access to Premium features until the end of your current billing period
  • No refunds are provided for partial subscription periods

5.4 Premium Features

Premium subscription includes:

  • Unlimited AI-powered chat about your books (powered by OpenAI)
  • Detailed insights and recommendations
  • Access to all advanced features

6. User Content

6.1 Your Content

  • You retain ownership of all content you submit to the App (books, notes, chat messages, etc.)
  • You grant us a license to store, process, and display your content to provide the service
  • When using AI chat features, your messages may be processed by third-party AI services (OpenAI) to generate responses

6.2 Prohibited Content

You agree not to submit content that:

  • Is illegal, harmful, or violates any laws
  • Infringes on intellectual property rights
  • Contains malware or malicious code
  • Is spam or unsolicited commercial content
  • Contains offensive, abusive, or inappropriate material when using AI chat features

7. Intellectual Property

7.1 Our Rights

  • The App, its features, and all content (except your user content) are owned by us or our licensors
  • You may not copy, modify, distribute, or create derivative works without permission

7.2 Third-Party Content and Services

  • Book information may be provided by third-party services (e.g., Google Books API)
  • AI chat features are powered by OpenAI. The use of OpenAI's services is subject to OpenAI's Terms of Use
  • We are not responsible for the accuracy of third-party content or AI-generated responses
  • AI-generated content is provided "as is" and may contain errors or inaccuracies

8. Prohibited Uses

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to the App or related systems
  • Interfere with or disrupt the App's operation
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems to access the App without permission
  • Use AI chat features to generate content that violates laws or rights of others
  • Attempt to extract or reverse engineer AI models or prompts

9. AI Services Disclaimer

The AI chat features in this App are powered by OpenAI. You acknowledge and agree that:

  • AI-generated responses may not always be accurate, complete, or current
  • You should not rely solely on AI-generated information for important decisions
  • We are not responsible for the content, accuracy, or quality of AI-generated responses
  • OpenAI may process your chat messages according to their privacy policy and terms of use
  • We may modify, suspend, or discontinue AI features at any time

10. Termination

10.1 By You

  • You may stop using the App at any time
  • You may delete your account at any time through the App settings

10.2 By Us

We may suspend or terminate your access to the App if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Required by law or regulatory authority
  • We discontinue the service

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP, INCLUDING AI FEATURES, WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. THIS INCLUDES, WITHOUT LIMITATION, ANY LIABILITY ARISING FROM THE USE OF OR RELIANCE ON AI-GENERATED CONTENT.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the App or violation of these Terms, including any claims related to content you submit or AI-generated content you use.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.
